1. Universal Constants

Welcome to THCA Space. By accessing our interstellar B2B platform, you agree to be bound by these terms, which govern your journey through our digital space.

Our platform operates in strict accordance with federal and state regulations regarding the distribution of cannabinoids for business purposes.

2. Account Navigation

Your account serves as your vessel through our platform. You are responsible for maintaining the confidentiality of your access credentials and for all activities under your account.

3. Trading in Our Orbit

All transactions must comply with applicable laws and regulations. We reserve the right to refuse service or terminate accounts that violate our terms or applicable regulations.

4. Terms of Sale

We do not accept returns for THCA products or other cannabinoids that require proper storage. It is the client's responsibility to ensure correct storage of these products to avoid any risk of exposure.

We are not responsible for any losses due to law enforcement actions. Clients must understand and comply with the laws and regulations of their respective countries or states regarding the possession and distribution of cannabinoids.

All sales are governed by the laws of the European Union. Prices are listed in EUR and are exclusive of any applicable taxes, duties, or fees unless otherwise stated. Payment terms, delivery schedules, and other specific conditions will be outlined in individual contracts.

Risk of loss and title for the products pass to the buyer upon full payment. We guarantee that all products meet the quality standards as specified and comply with EU regulations. Any disputes arising from sales will be resolved under the jurisdiction of the courts in the European Union.

Clients are responsible for ensuring that their use and distribution of our products comply with all applicable EU and local laws. We disclaim any liability for misuse of products or unauthorized distribution.

5. Delivery Policy

All shipments traverse the cosmic pathways to reach you within 3-7 business days within the EU, subject to customs clearance where applicable.

Orders are typically processed within 72 hours of confirmation, certain products may take longer to process at times. Tracking information will be provided via your account dashboard and email.

We utilize discreet packaging compliant with EU regulations for cannabinoid products. All shipments require signature confirmation from an authorized representative of your business.

For orders exceeding €5,000, we offer free shipping. Otherwise, shipping costs are calculated based on weight, destination, and desired shipping method.

We are not responsible for delays caused by customs, regulatory inspections, or force majeure events including but not limited to natural disasters, strikes, or unforeseen cosmic disturbances.

6. Return Policy

Due to the nature of our products, we maintain a strict no-return policy for opened cannabinoid products, as we cannot guarantee their integrity once they have left our controlled environment.

For unopened products that are damaged during transit, we accept returns within 48 hours of delivery. Photographic evidence of damaged packaging must be provided.

Non-cannabinoid items may be returned within 14 days if in original packaging and unused condition. A 15% restocking fee applies.

Return shipping costs are the responsibility of the buyer unless the return is due to our error.

All return requests must be submitted through our portal with order details and reason for return.

7. Refund Policy

Approved returns will be refunded to the original payment method within 14 business days of our receipt and inspection of returned items.

For damaged goods, we offer either replacement shipment or full refund at our discretion.

Partial shipments or discrepancies must be reported within 24 hours of delivery for refund consideration.

Refunds do not include original shipping charges unless return is due to our error.

For bulk orders with custom specifications, refunds are subject to additional terms outlined in the specific sales agreement.

8. Cancellation Policy

Orders may be cancelled without penalty within 4 hours of placement.

Orders cancelled between 4-24 hours after placement incur a 10% processing fee.

Orders cancelled after 24 hours but before shipping are subject to a 25% cancellation fee.

Orders that have entered the shipping process cannot be cancelled and must follow our return policy if applicable.

For custom or bulk orders, cancellation terms are specified in the individual contract and may differ from standard policy.

9. Governing Law & Dispute Resolution

These Terms of Service and all transactions conducted through our platform are governed by the laws of the European Union, specifically those of The Netherlands, France and Sweden.

Any disputes arising from or relating to these terms or transactions shall be subject to the exclusive jurisdiction of the courts in The Netherlands, France or Sweden.

Prior to initiating legal proceedings, parties agree to attempt resolution through formal mediation conducted in accordance with EU regulations on alternative dispute resolution.

The prevailing party in any dispute shall be entitled to recover reasonable legal fees and costs incurred in resolving such dispute.

These terms shall be interpreted in accordance with the General Data Protection Regulation (GDPR) and other applicable EU directives regarding e-commerce and cannabinoid products.

10. B2B Specific Provisions

All transactions are intended solely for business entities legally authorized to handle cannabinoid products. We verify business credentials before approving accounts.

Buyers are required to maintain compliance with Novel Food regulations for CBD products and applicable EU regulations for other cannabinoids.

Bulk pricing is available for qualified buyers and subject to separate volume agreements. Minimum order quantities apply and vary by product category.

Buyers agree to not reverse-engineer our products or attempt to determine proprietary formulations and processes.

Credit terms are available for established business relationships subject to credit approval. Standard terms are net-30 unless otherwise specified.

11. Product Compliance & Testing

All products are tested by EU-certified laboratories with full certificates of analysis available upon request.

THC content in all products complies with the EU threshold of less than 0.2% or 0.3% depending on applicable jurisdiction.

We make no medical claims regarding our products. Buyers agree not to market purchased products with unapproved health or medical claims.

Products are compliant with EU regulations on contaminants, heavy metals, pesticides, and microbial limits.

Batch tracking and traceability systems are maintained in compliance with EU GMP standards where applicable.
